Conditions of Carriage
1.    Carriage of passengers and their luggage, including their vehicles, shall be pursuant to the Marine Liability Act, S.C. 2001, c.6 and amendments thereto and all terms defined in such Act shall have the same meanings under these conditions.

2.    No Bill of Lading is issued in respect of this carriage and the Hague-Visby Rules do not apply.

3.    The Carrier shall not be responsible for any loss, damage or inconvenience suffered by any passenger resulting from late, delayed or cancelled sailings, arrivals or departures regardless of the cause or from any change or deviation in any schedule of sailing times from those published by the Carrier.

4.    All fares, tariffs or surcharges are subject to change without notice. Cost of carriage is subject to changes in fares, tariffs or surcharges effected prior to carriage, such increased amounts to be paid prior to boarding.

5.    In order to protect the health, safety, security and comfort of its passengers, the Carrier reserves the right to refuse transportation to any person, vehicle, article or goods or to remove same from any vessel, or from any terminal or other property occupied by the Carrier. The Carrier’s Rules and Requirements for terminal operations and carriage are available from any terminal manager and are posted on the Carrier’s website at bcferries.com. The Carrier is under no obligation to accept for carriage any luggage or accept any vehicle, article or goods which do not meet its requirements with respect to identification or condition. The Carrier has the right, but not the obligation, to verify in the presence of the passenger the contents of luggage, and, to open and examine such luggage whether or not the passenger is present.

6.    For good order and security, passengers agree to follow the directions of any employee of the Carrier in respect of use or operation of the terminal or vessel. When requested by any employee, passengers will provide proof of identification satisfactory to the Carrier and will answer any enquiry and produce any documents requested by the employee in respect to any luggage, vehicle or its contents. Persons who refuse to provide information or documentation as required; who refuse to follow directions of any employee, sign or device in any terminal or on board any vessel; who interfere with or molest other passengers; who interfere with the operation of a terminal or vessel; or who interfere with any employee of the Carrier, may be refused passage, ordered off the vessel and evicted from the terminal. The Carrier will rely on section 83 of the Canada Shipping Act, 2001, S.C. 2001, c.26 and amendments thereto and section 494(2) of the Criminal Code of Canada, R.S.C.

7.    Any and all costs incurred by the Carrier in respect of any luggage or vehicle left unattended or in an unauthorized location or for non-payment of fees or expenses shall be for the account of the passenger and the Carrier shall have a lien on such luggage or vehicle for such amounts. If the owner or driver of any vehicle does not drive the vehicle on or off its vessel in accordance with the directions of the Carrier, then the Carrier may remove the vehicle from the vessel at the sole risk and expense of the owner or driver. The Carrier shall not be liable for any damage caused by or to such vehicle or its contents even if caused by the Carrier’s negligence.

8.    No vehicle shall be deemed to have been taken over by the Carrier until such vehicle is permanently at rest on board the vessel prior to sailing and shall be deemed to be redelivered by the Carrier on commencement of discharge from the vessel. At all other times, vehicles are under the care, custody and control of the owner or driver of the vehicle and responsibility for any loss or damage to or by the vehicle shall be with the owner or driver of the vehicle, notwithstanding any direction given by the Carrier in respect of that vehicle. The owner or driver of the vehicle is responsible for properly securing the vehicle and its contents throughout the voyage. The Carrier is not responsible for theft of the vehicle or of its contents, or for damage to any vehicle not due to the negligence of the carrier.

9.    For the purpose of these Conditions of Carriage, the Carrier includes every agent, servant and employee of the Carrier and any corporation owned by, subsidiary to or associated or affiliated with the Carrier, including every independent contractor from time to time employed by the Carrier and every right of whatsoever nature applicable to the Carrier or to which the Carrier is entitled hereunder or by statute or common law shall also be available and shall extend to each of them.

10.    The Carrier shall not be liable for any loss, detention, damage, injury causing death or illness caused to or by live animals however or wherever such loss, detention, damage or injury occurs even though caused by any act, neglect or default of the Carrier.

11.    The Carrier shall not be liable for the quality, nature or consequence of any medical or surgical treatment or assistance which may be administered, notwithstanding that the said medical or surgical treatment or assistance is done negligently. Passengers are required to advise the Carrier of any and all health issues or concerns prior to entering into the contract of carriage.

12.    If directed or requested by a governmental authority to do so, the Carrier may refuse carriage to any person or vehicle for any reason including travel for non-essential purposes.

13.    The Carrier may amend these Conditions of Carriage at any time.
Booking Cancellation/Change policies
Sailing Cancellations

Cancelled sailings – day of travel

We'll do our best to get you on the next available sailing if your sailing is cancelled. Scheduled sailings may need to be cancelled from time-to-time as a result of severe weather conditions, mechanical difficulties or other unforeseen circumstances.
 

If you checked in at the terminal and the sailing is then cancelled

We will make every effort to load you on the next available sailing where space is available.

Customers with a booking on the next scheduled departure will be loaded in advance of customers from the cancelled sailing. If we are unable to load you on the next available sailing, you will be loaded in order of arrival at the terminal.

If you choose not to travel, return to the ticket booth to check out of the terminal. Your fares and any reservation fees will be automatically refunded to your original form of payment. Any changes made to your booking at the terminal will also be automatically refunded, with the exception of a cash or cash equivalent transactions, which need to be processed by a ticket agent at the terminal.

If your sailing is cancelled before you check-in at the terminal

We will make every effort to move your booking to an alternate sailing, later in the day, based on space availability. This will occur at no cost to you, regardless of the fare you paid. Future sailings may have limited reservation space due to previous bookings.

If your booking is moved, you will be notified. If we are not able to move your booking, you will be notified in advance that your booking has been cancelled, your fares and any reservation fees will be refunded.

If you choose to travel without a booking on a later sailing, you can purchase a Standard at Terminal fare and be loaded on the next available sailing based on order of arrival at the terminal and deck space availability.

To get a refund for a cancelled sailing if you left the terminal without going through the ticket booth, you can also mail copies of your receipts to Customer Relations.

If your booking is moved, you will be notified. If we are not able to move your booking, you will be notified in advance that your booking has been cancelled, your fares and any reservation fees will be refunded.

Terms of Use and Agreement

IMPORTANT -- PLEASE READ: This BC Ferries Experience™ Card Terms of Use and Agreement (“Agreement”) outlines the terms and conditions that apply to your use of your BC Ferries Experience™ Card.

By using the BC Ferries Experience™ Card, you agree to the terms of this Agreement.

A.    RULES AND RESTRICTIONS WITH RESPECT TO STORED VALUE (also referred to as “money”)

1.    BC Ferries Experience™ Card users may load money onto their BC Ferries Experience™ Card online at www.bcferries.com, by phone via the BC Ferries Customer Service Centre or in person at participating BC Ferries Terminal Administration Offices and Ticket Booths.

2.    BC Ferries reserves the right to limit the amount of money loaded to a BC Ferries Experience™ Card. The maximum amount of Stored Value which may be loaded is $3,000. Required minimum amounts of Stored Value are subject to change from time to time and may be obtained at www.bcferries.com, in person at any participating BC Ferries Terminal Administration Office, or by calling BC Ferries’ Customer Service Centre at 1-888-BC FERRY (1-888-223-3779).

3.    Stored Value must be treated like cash.

4.    Stored Value may only be used as payment toward the cost of carriage.

5.    Stored Value is non-refundable.

6.    Stored Value may not be resold.

7.    BC Ferries Experience™ cardholders must have their card in their possession and visible at time of payment. It is not possible to use Stored Value if a cardholder does not have their BC Ferries Experience™ Card present.

8.    BC Ferries Experience™ cardholders can elect to receive access to reduced fares on participating routes by choosing to load minimum amounts of Stored Value:

      (a)    to receive access to Passenger-Only reduced fares on participating routes; and/or

      (b)    to receive access to Vehicle and Passenger reduced fares on participating routes.

Participating routes and minimum levels of Stored Value required for entitlement to reduced fares are subject to change from time to time and may be obtained at www.bcferries.com, in person at any participating BC Ferries Terminal Administration Office, or by calling BC Ferries’ Customer Service Centre at 1-888-BC FERRY (1-888-223-3779).
 
9.    Once minimum amounts of Stored Value have been loaded in accordance with section 8, to receive the reduced fare on participating routes, BC Ferries Experience™ cardholders must have a card balance that is at least equal to the total amount of the reduced fare. It is not possible to receive the reduced fare if a card balance is less than the total amount of the reduced fare.

10.    Stored Value can be transferred between cards as follows:

      (a)    Cards can be identified as primary or secondary on an account. Secondary cards must be connected to a primary card. Stored Value can be transferred or shared between primary and secondary cards. See "Transfers and Pooling Between Cards" below.

      (b)    Primary cardholders must elect to receive access to reduced fares for either Passenger-only or Vehicle and Passenger fares. Secondary cards will receive the access to reduced fares as selected for the primary card. Access to reduced fares must always be the same between primary and secondary cards.

B.    BC FERRIES EXPERIENCE™ CARD GENERAL TERMS

1.    Any travel associated with the use of the BC Ferries Experience™ Card is subject to BC Ferries’ Conditions of Carriage, available at www.bcferries.com or at any Terminal Administration Office.

2.    The BC Ferries Experience™ Card is issued to you by BC Ferries. Cards are non- transferable and the Stored Value is only redeemable by the registered cardholder for BC Ferries products and services at participating BC Ferries locations. Your BC Ferries Experience™ Card is reusable and has no value until it is loaded with Stored Value.

3.    No credit card, credit line or overdraft protection is associated with a BC Ferries Experience™ Card. Unless otherwise required by law or permitted by this Agreement, any amount on your BC Ferries Experience™ Card is non-refundable. No interest, dividends, or any other earnings on funds deposited to a BC Ferries Experience™ Card will accrue or be paid or credited to you by BC Ferries.

4.    BC Ferries reserves the right to not accept any BC Ferries Experience™ Card or otherwise limit use of a BC Ferries Experience™ Card if it reasonably believes that the use is unauthorized, fraudulent or otherwise unlawful.

5.    All amounts loaded onto your BC Ferries Experience™ Card are held and denominated in Canadian Dollars.

6.    Registration.

      (a)    Card registration is optional. BC Ferries Experience™ Cardholders may register their BC Ferries Experience™ Card by visiting www.bcferries.com, in person at any BC Ferries Terminal Administration Office or by calling our Customer Service Centre at 1-888-BC FERRY (1-888-223-3779).

      (b)    Registering your BC Ferries Experience™ Card or updating your account profile information requires that you provide personal information including name, address, phone number, email and password.
 
      (c)    By registering your BC Ferries Experience™ Card, you will receive:

            (i)    Access to your account on-line. With your email and password (provided at time of registration) you may access your BC Ferries Experience™ Card profile and usage information by visiting www.bcferries.com. Information available to registered cardholders includes balance summary, transaction details for the previous 36 months and the ability to review and update profile information.

            (ii)    Loss protection. Cardholders whose BC Ferries Experience™ Card is registered may report their card lost or stolen by calling our Customer Service Centre at 1-888-BC FERRY (1-888-223-3779), or in-person at the participating Terminal Administration Office. The card balance will be frozen as of the time of the report and the card will be cancelled, rendering it unusable. The remaining balance may then be transferred to a new BC Ferries Experience™ Card. To transfer your balance, call the BC Ferries Customer Service Centre at 1-888-BC FERRY (1-888-223-3779) or go in-person to any participating BC Ferries Terminal Administration Building. Customers may be required to answer a series of questions or present picture ID to confirm their identity. Your replacement card can be registered on your existing customer profile for continued loss protection.

            (iii)    Setup Auto-Purchase. Registered cardholders may configure the ability to have a dollar amount automatically loaded for use on their BC Ferries Experience™ Card when a dollar amount reaches a level provided. Minimum dollar amounts apply to automatic purchase of Stored Value. Such minimum amounts are subject to change from time to time and details thereof may be obtained at www.bcferries.com, in person at any participating BC Ferries Terminal Administration Office or by calling our Customer Service Centre at 1-888-BC FERRY (1-888-223-3779). You will be required to provide credit card information to use this feature. A receipt with transaction details will be emailed to you at the email address provided on your profile. You may cancel this feature at any time by accessing your account at www.bcferries.com or by visiting any participating Terminal Administration Office.

            (iv)    Transfers and Pooling Between Cards. When adding secondary cards to their account, registered primary cardholders may configure connected secondary cards to operate with either Pooling or Transfer functionality. These terms are defined as follows:


                  (1)    Pooling: Selecting the Pooling section allows a secondary cardholder to share the primary card's balance. The Pooling setting does not allow a secondary card to carry its own balance.

                  (2)    Transfer: Selecting the Transfer setting gives the primary cardholder the ability to transfer money to the selected secondary card. The transfer setting allows a secondary card to carry its own balance.

            (v)    Save Card on File. Registered cardholders can save a credit card on their account for on-demand transactions. You will be required to provide credit card information to use this feature. You can set up or cancel this feature at any time by accessing your account at www.bcferries.com, by calling our Customer Service Centre at 1-888-BC FERRY (1-888-223-3779) or in person at any participating BC Ferries Terminal Administration Office.

7.    Liability for Unauthorized Transactions.

Because your BC Ferries Experience™ Card are used like cash, you are responsible for all transactions associated with your BC Ferries Experience™ Card, including unauthorized transactions.

8.    Receipts and Statements.

      (a)    Travel and Transaction History Reports: Registered BC Ferries Experience™ Card users will have access to travel and transaction history reports showing all travel and transactions that have taken place on the card in the previous 36 months.

      (b)    Online (Internet) access: Only registered cardholders may access their account online. See Registration section above.

      (c)    Phone access: Cardholders may obtain their card balance information by calling our Customer Service Centre at 1-888-BC FERRY (1-888-223-3779) and using the Automated Voice Response system or by speaking with a Customer Service Representative. You will be required to provide your BC Ferries Experience™ Card number and Card Verification Number found on the back of your card.

      (d)    In Person: Cardholders may receive account balance information and transaction details in-person at participating BC Ferries ticket booths and Terminal Administration Offices.

      (e)    Point of Sale Usage Report: Whenever you use your BC Ferries Experience™ Card at Point of Sale, you will be provided a “BC Ferries Experience™ Card Usage Report” with your receipt. This report will list the Stored Value balances currently on your card.

9.    Privacy Statement.

Additionally, BC Ferries may analyze aggregated, non-identifiable customer information collected from registered BC Ferries Experience™ Card customers for the purposes of developing or enhancing products and services that meet the needs of our customers.

10.    Changes to This Agreement.

We may amend the terms of this Agreement at any time, including any rights or obligations you or we may have. We will post the terms of the modified agreement on our website at www.bcferries.com. As permitted by applicable law, any change, addition or deletion will become effective at the time we post the revised agreement to our website or as otherwise stated in our notice to you. Unless we state otherwise, the change, addition or deletion will apply to your future and existing BC Ferries Experience™ Cards. You are deemed to accept the changes, additions or deletions if (1) you do not notify us to the contrary in writing within twenty (20) days of the date of our posting thereof or such other time specified with such posting, or (2) you use your BC Ferries Experience™ Card during or after such notice period. If you do not accept the changes, additions or deletions, your BC Ferries Experience™ Card will be cancelled and any amounts remaining on your BC Ferries Experience™ Card will be refunded to you.

11.    Cancellation of This Agreement.

We may suspend or terminate this Agreement and revoke or limit any or all of the rights and privileges granted to you at any time without notice or liability. Termination may result from fraudulent or unauthorized use of the BC Ferries Experience™ Card. If we terminate this Agreement without cause, we will refund an amount equal to the balance held in your BC Ferries Experience™ Card account less any amounts that you may owe us. In the event that this Agreement is terminated, this Part shall survive in accordance with its terms.

12.    Errors, Corrections, Omissions.

We reserve the right to correct the balance of your BC Ferries Experience™ Card account if we believe that a clerical or accounting error occurred. If you have questions regarding your transaction history, or if you dispute any transaction or correction that has been assessed against your BC Ferries Experience™ Card, please call our customer service department at 1-888-BC FERRY (1-888-223-3779). We will conduct an investigation and communicate the results and correct any error that we verify as soon as we finish the investigation. If no error is found, we will communicate an explanation. We will have no liability for any error unless you contact us within sixty (60) days of the date of the transaction in question. We recommend that you monitor your transactions and account balances closely.

13.    Governing Law – British Columbia.

This Agreement shall be governed by and construed in accordance with the laws of the Province of British Columbia and the laws of Canada applicable therein notwithstanding any conflict of law rules.

14.    Dispute resolution.

Please read this section carefully. It affects rights that you may otherwise have. It provides for resolution of most disputes through arbitration instead of court trials and class actions. Arbitration is final and binding and subject to only very limited review by a court. This arbitration clause shall survive termination of this Agreement.

      (a)    Binding Arbitration: This provision is intended to be interpreted broadly to encompass all disputes or claims arising out of our relationship. Any dispute or claim made by you against us (or against any of our affiliated companies) arising out of or relating to this Agreement or your use of the BC Ferries Experience™ Card will be resolved by binding arbitration except that (a) you may take claims to small claims court if they qualify for hearing by such a court, or (b) you or we may choose to pursue claims in court if the claims relate solely to the collection of any debts you owe to us. However, even for those claims that may be taken to court, you and we both waive any claims for punitive damages and any right to pursue claims on a class or representative basis.

      (b)    Arbitration Procedures: You must first present any claim or dispute to us by contacting our Customer Service Centre to allow us an opportunity to resolve the dispute. You may request arbitration if your claim or dispute cannot be resolved within 120 days. The arbitration of any dispute or claim shall be conducted in accordance with the Commercial Arbitration Act (BC) as modified by this Agreement. Unless you and we agree otherwise, any arbitration will take place in Vancouver, British Columbia, and will be conducted in the English language. An arbitrator may not award relief in excess of or contrary to what this Agreement provides, order consolidation or arbitration on a class wide or representative basis, or award punitive damages or any other damages aside from the prevailing party's actual damages, except that the arbitrator may award on an individual basis damages required by statute and may order injunctive or declaratory relief pursuant to an applicable consumer protection statute. Any arbitration shall be confidential, and neither you nor we may disclose the existence, content or results of any arbitration, except as may be required by law or for purposes of enforcement of the arbitration award. Judgment on any arbitration award may be entered in any court having proper jurisdiction. If any portion of this arbitration clause is determined by a court to be inapplicable or invalid, than the remainder shall still be given full force and effect.

      (c)    Costs of Arbitration: All administrative fees and expenses of arbitration will be divided equally between you and us. In all arbitrations, each party will bear the expense of its own counsel, experts, witnesses and preparation and presentation of evidence at the arbitration.

      (d)    Waiver of Punitive Damage Claims and Class Actions: By this Agreement, both you and we are waiving certain rights to litigate disputes in court. If for any reason this arbitration clause is deemed inapplicable or invalid, you and we both waive, to the fullest extent allowed by law, any claims to recover punitive or exemplary damages and any right to pursue any claims on a class or consolidated basis or in a representative capacity.

15.    Disclaimers and Limits of Liability.

BC FERRIES AND ITS AFFILIATES MAKE NO REPRESENTATIONS, WARRANTIES OR CONDITIONS OF ANY KIND, EXPRESS OR IMPLIED, WITH RESPECT TO THE BC FERRIES EXPERIENCE™ CARD, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT, OR ANY WARRANTY ARISING BY USAGE OF TRADE, COURSE OF DEALING OR COURSE OF PERFORMANCE. BC FERRIES DOES NOT REPRESENT OR WARRANT THAT YOUR BC FERRIES EXPERIENCE™ CARD WILL ALWAYS BE ACCESSIBLE OR ACCEPTED.

IN THE EVENT THAT BC FERRIES OR ITS AFFILIATES ARE FOUND LIABLE TO YOU, YOU SHALL ONLY BE ENTITLED TO RECOVER ACTUAL AND DIRECT DAMAGES AND SUCH DAMAGES SHALL NOT EXCEED THE LAST BALANCE HELD ON YOUR BC FERRIES EXPERIENCE™ CARD. BC FERRIES AND ITS AFFILIATES SHALL HAVE NO LIABILITY FOR ANY INCIDENTAL, INDIRECT OR CONSEQUENTIAL DAMAGES (INCLUDING WITHOUT LIMITATION LOSS OF PROFIT, REVENUE OR USE) ARISING OUT OF OR IN ANY WAY CONNECTED WITH THIS AGREEMENT, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE, WHETHER ACTIVE, PASSIVE OR IMPUTED), PRODUCT LIABILITY, STRICT LIABILITY OR OTHER THEORY, EVEN IF WE OR OUR AUTHORIZED REPRESENTATIVES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL BC FERRIES OR ITS AFFILIATES HAVE ANY LIABILITY FOR UNAUTHORIZED ACCESS TO, OR ALTERATION, THEFT OR DESTRUCTION OF A BC FERRIES EXPERIENCE™ CARD THROUGH ACCIDENT, MISUSE, OR FRAUDULENT MEANS OR DEVICES BY YOU OR ANY THIRD PARTY, OR AS A RESULT OF ANY DELAY OR MISTAKE RESULTING FROM ANY CIRCUMSTANCES BEYOND OUR CONTROL.

The laws of certain provinces or other jurisdictions may not allow limitations on implied warranties, or the exclusion or limitation of certain damages. If these laws apply, some or all of the above disclaimers, exclusions, or limitations may not apply to you, and you may have rights in addition to those contained in this Agreement. In such jurisdiction, our liability is limited to the greatest extent permitted by law.

16.    Assignment.

We may assign all or part of this Agreement without such assignment being considered a change to the Agreement and without notice to you. We will then be released from all liability. The assignee shall have the same rights and obligations as BC Ferries and shall agree in writing to be bound by the terms and conditions of this Agreement.

17.    Entire Agreement Construction.

This Agreement is the complete and exclusive statement of agreement between you and British Columbia Ferry Services Inc., and supersedes and merges all prior proposals and all other agreements. In the event that any provision of this Agreement shall be determined to be illegal or unenforceable, that provision will be eliminated to the minimum extent necessary so that this Agreement shall otherwise remain in full force and effect and enforceable. Headings herein are for convenience of reference only and shall in no way affect interpretation of this Agreement.

IMPORTANT -- PLEASE READ: This Assured Loading Card Terms of Use and Agreement (“Agreement”) outlines the terms and conditions that apply to your use of your BC Ferries Assured Loading Card. By using the BC Ferries Assured Loading Card, you agree to the terms of this Agreement.

A.    RULES AND RESTRICTIONS WITH RESPECT TO ASSURED LOADING TICKETS:

1.    Once your BC Ferries Assured Loading Card has been registered, you may purchase Assured Loading Tickets (“ALTs”) for your BC Ferries Assured Loading Card online at www.bcferries.com or in person at any BC Ferries Terminal Administration Office or Ticket Booth where ALTs are accepted. For a list of locations where ALTs are accepted, visit www.bcferries.com, or call 1-888-BC FERRY (1-888-223-3779).

2.    ALTs expire on the last day of the 24th month from the date of purchase, after which time expired ALTs will not be accepted at point of sale. The value of expired ALTs is not refundable but may, for a period of six (6) months after expiry only, be used toward the purchase of new ALTs. Current product balance and expiry dates are available at point of sale, on BC Ferries’ website at www.bcferries.com, in person at any participating BC Ferries Terminal Administration Office or by calling BC Ferries’ Customer Service Centre at 1-888-BC FERRY (1-888-223-3779).

3.    BC Ferries reserves the right to limit the number of assured loading spaces on each sailing or to deny assured loading privileges during periods of peak demand and/or reduced capacity as determined by BC Ferries in its discretion.

4.    BC Ferries reserves the right to limit ALT quantities held on the BC Ferries Assured Loading Card to a maximum of $3,000 worth of ALTs. BC Ferries may change the maximum and minimum amounts at any time by notifying you at the point of sale, by email message to the address you provided on your Assured Loading Card registration, by phone when you call, or on the BC Ferries website, and such notice of change shall constitute an amendment to this Agreement.

5.    ALTs are valid only when presented to a BC Ferries Ticket Agent at least 20 minutes before the SCHEDULED departure time of the ferry where ALTs are accepted.

6.    ALTs are non-refundable and non-transferable.

7.    BC Ferries Assured Loading Cards containing ALTs may be presented in payment of one driver fare and one passenger vehicle up to 2.13 m (7') in height and 6.10m (20') in length. ALTs are for single vehicles only, and cannot be used for vehicles towing a trailer.

8.    BC Ferries Assured Loading Cards containing ALTs may be presented at all open ticket booths regardless of the displayed destination at the ticket booth.

9.    If you use your BC Ferries Assured Loading Card to gain priority access to a ticket booth, ahead of a queue, and you do not have sufficient existing ALTs on your BC Ferries Assured Loading Card prior to such time, you will be required to return to the end of the queue.

10.    If you are travelling as part of a group with more than one vehicle, you may redeem more than one ALT per sailing. However, BC Ferries reserves the right to limit the number of ALTs redeemed by you per sailing. ALTs are subject to changes in fares, tariffs or surcharges affected prior to use, such increased amounts to be paid prior to boarding. For current fares, see "Fares" at www.bcferries.com.

B.    BC FERRIES ASSURED LOADING CARD GENERAL TERMS

1.    Any travel associated with the use of the BC Ferries Assured Loading Card is subject to BC Ferries’ Conditions of Carriage, available at www.bcferries.com or at any Terminal Administration Office.

2.    Cards are non-transferable and ALTs are only redeemable by the registered cardholder at participating BC Ferries locations. Your BC Ferries Assured Loading Card is reusable and has no value until it is loaded with ALTs.

3.    BC Ferries reserves the right to not accept any BC Ferries Assured Loading Card or otherwise limit use of a BC Ferries Assured Loading Card if it reasonably believes that the use is unauthorized, fraudulent or otherwise unlawful.

4.    All ALT amounts loaded onto your BC Ferries Assured Loading Card are held and denominated in Canadian Dollars.

5.    Registration.

      (a)    Registration of Assured Loading Cards is mandatory. To register your BC Ferries Assured Loading Card, visit www.bcferries.com and complete and submit the card registration form. After the form has been completed and submitted to BC Ferries, you will receive a confirmation email message (“Confirmation Email”) from BC Ferries. In order to activate your card, you must click on the link provided in the Confirmation Email. Your card will not be valid until activated. No ALTs may be loaded onto a new BC Ferries Assured Loading Card until it has been activated.

      (b)    Registering your BC Ferries Assured Loading Card or updating your account profile information requires that you provide personal information including name, address, phone number, email and password.

      (c)    With your registered BC Ferries Assured Loading Card, you will receive:

            (i)    Access to your account on-line. With your email and password (provided at time of registration) you may access your BC Ferries Assured Loading Card profile and usage information by visiting www.bcferries.com. Information available to registered cardholders includes balance summary, transaction details for the previous 36 months and the ability to review and update profile information.

            (ii)    Loss protection. Cardholders whose BC Ferries Assured Loading Card is registered may report their card lost or stolen by calling our Customer Service Centre at 1-888-BC FERRY (1-888-223-3779), or in-person at the participating Terminal Administration  Office. Any ALTs on the card will be frozen as of the time of the report and the card will be cancelled, rendering it unusable. The remaining ALTs may then be transferred to a new BC Ferries Assured Loading Card. To transfer your ALTs, call the BC Ferries Customer Service Centre at 1-888-BC FERRY (1-888-223-3779) or go in-person to any participating BC Ferries Terminal Administration Building.  Customers may be required to answer a series of questions or present picture ID to confirm their identity. Your replacement card can be registered on your existing customer profile for continued loss protection.

            (iii)    Setup Auto-Purchase. Registered cardholders may configure the ability to have ALTs automatically purchased or loaded for use on their BC Ferries Assured Loading Card when ALT quantity reaches a level provided. You will be required to provide credit card information to use this feature. A receipt with transaction details will be emailed to you at the email address provided on your profile. You may cancel this feature at any time by accessing your account at www.bcferries.com or by calling the BC Ferries Customer Service Centre at 1-888-BC FERRY (1-888-223-3779).

            (iv)    Save Card on File. Registered cardholders can save a credit card on their account for on-demand transactions. You will be required to provide credit card information to use this feature. You can set up or cancel this feature at any time by accessing your account at www.bcferries.com, by calling our Customer Service Centre at 1-888-BC FERRY (1-888-223-3779) or in person at any participating BC Ferries Terminal Administration Office.

6.    Liability for Unauthorized Transactions.

Because your BC Ferries Assured Loading Card is used like cash, you are responsible for all transactions associated with your BC Ferries Assured Loading Card, including unauthorized transactions.

7.    Account Information.

      (a)    Travel and Transaction History Reports: Registered BC Ferries Assured Loading Card users will have access to travel and transaction history reports showing all travel and transactions that have taken place on the card for up to 36 months.

      (b)    Online (Internet) access: Registered Assured Loading Cardholders may access their account online. See Registration section above.

      (c)    Phone access: Cardholders may obtain their Assured Loading Card balance information by calling our Customer  Service Centre at 1-888-BC FERRY (1-888-223-3779) and using the Automated Voice Response system or by speaking with a Customer Service Representative. You will be required to provide your BC Ferries Assured Loading Card number and Card Verification Number found on the back of your card.

      (d)    In Person: Cardholders may receive account information and transaction details in-person at participating BC Ferries ticket booths and Terminal Administration Offices.

      (e)    Point of Sale Usage Report: Whenever you use your BC Ferries Assured Loading Card at Point of Sale, you will be provided a “BC Ferries Assured Loading Card Usage Report”  with your receipt. This report will list ALTs currently on your card.

8.    Privacy Statement.

For information concerning how we collect, use and disclose personal information, please refer to our privacy statement at https://www.bcferries.com/privacy-statement.html 

Additionally, BC Ferries may analyze aggregated, non-identifiable customer information collected from registered BC Ferries Assured Loading Card customers for the purposes of developing or enhancing products and services that meet the needs of our customers.

9.    Changes to this Agreement.

We may amend the terms of this Agreement at any time, including any rights or obligations you or we may have. We will post the terms of the modified agreement on our website at www.bcferries.com. As permitted by applicable law, any change, addition or deletion will become effective at the time we post the revised agreement to our website or as otherwise stated in our notice to you. Unless we state otherwise, the change, addition or deletion will apply to your future and existing BC Ferries Assured Loading Cards. You are deemed to accept the changes, additions or deletions if (1) you do not notify us to the contrary in writing within twenty (20) days of the date of our posting thereof or such other time specified with such posting, or (2) you use your BC Ferries Assured Loading Card during or after such notice period. If you do not accept the changes, additions or deletions, your BC Ferries Assured Loading Card will be cancelled and any ALTs remaining on your BC Ferries Assured Loading Card will be refunded to you.

10.    Cancellation of this Agreement.

We may suspend or terminate this Agreement and revoke or limit any or all of the rights and privileges granted to you at any time without notice or liability. Termination may result from fraudulent or unauthorized use of the BC Ferries Assured Loading Card. If we terminate this Agreement without cause, we will refund an amount equal to the balance held in your BC Ferries Assured Loading Card account less any amounts that you may owe us. In the event that this Agreement is terminated, this section shall survive in accordance with its terms.

11.    Errors, Corrections, Omissions.

We reserve the right to correct the balance of your BC Assured Loading Card account if we believe that a clerical or accounting error occurred. If you have questions regarding your transaction history, or if you dispute any transaction or correction that has been assessed against your BC Ferries Assured Loading Card, please call our customer service department at 1-888-BC FERRY (1-888-223-3779). We will conduct an investigation and communicate the results and correct any error that we verify as soon as we finish the investigation. If no error is found, we will communicate an explanation. We will have no liability for any error unless you contact us within sixty (60) days of the date of the transaction in question. We recommend that you monitor your transactions and account balances closely.

12.    Governing Law – British Columbia.

This Agreement shall be governed by and construed in accordance with the laws of the Province of British Columbia and the laws of Canada applicable therein notwithstanding any conflict of law rules.

13.    Dispute Resolution.

Please read this section carefully. It affects rights that you may otherwise have. It provides for resolution of most disputes through arbitration instead of court trials and class actions. Arbitration is final and binding and subject to only very limited review by a court. This arbitration clause shall survive termination of this Agreement.

      (a)    Binding Arbitration: This provision is intended to be interpreted broadly to encompass all disputes or claims arising out of our relationship. Any dispute or claim made by you against us (or against any of our affiliated companies) arising out of or relating to this Agreement or your use of the BC Ferries Assured Loading Card will be resolved by binding arbitration except that (a) you may take claims to small claims court if they qualify for hearing by such a court, or (b) you or we may choose to pursue claims in court if the claims relate solely to the collection of any debts you owe to us. However, even for those claims that may be taken to court, you and we both waive any claims for punitive damages and any right to pursue claims on a class or representative basis.

      (b)    Arbitration Procedures: You must first present any claim or dispute to us by contacting our Customer Service Centre to allow us an opportunity to resolve the dispute. You may request arbitration if your claim or dispute cannot be resolved within 120 days. The arbitration of any dispute or claim shall be conducted in accordance with the Commercial Arbitration Act (BC) as modified by this Agreement. Unless you and we agree otherwise, any arbitration will take place in Vancouver, British Columbia, and will be conducted in the English language. An arbitrator may not award relief in excess of or contrary to what this Agreement provides, order consolidation or arbitration on a class-wide or representative basis, or award punitive damages or any other damages aside from the prevailing party's actual damages, except that the arbitrator may award on an individual basis damages required by statute and may order injunctive or declaratory relief pursuant to an applicable consumer protection statute. Any arbitration shall be confidential, and neither you nor we may disclose the existence, content or results of any arbitration, except as may be required by law or for purposes of enforcement of the arbitration award. Judgment on any arbitration award may be entered in any court having proper jurisdiction. If any portion of this arbitration clause is determined by a court to be inapplicable or invalid, than the remainder shall still be given full force and effect.

      (c)    Costs of Arbitration: All administrative fees and expenses of arbitration will be divided equally between you and us.  In all arbitrations, each party will bear the expense of its own counsel, experts, witnesses and preparation and presentation of evidence at the arbitration.

      (d)    Waiver of Punitive Damage Claims and Class Actions: By this Agreement, both you and we are waiving certain rights to litigate disputes in court. If for any reason this arbitration clause is deemed inapplicable or invalid, you and we both waive, to the fullest extent allowed by law, any claims to recover punitive or exemplary damages and any right to pursue any claims on a class or consolidated basis or in a representative capacity.

14.    Disclaimers and Limits of Liability.

BC FERRIES AND ITS AFFILIATES MAKE NO REPRESENTATIONS, WARRANTIES OR CONDITIONS OF ANY KIND, EXPRESS OR IMPLIED,  WITH RESPECT TO THE BC FERRIES ASSURED LOADING CARD, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT, OR ANY WARRANTY ARISING BY USAGE OF TRADE, COURSE OF DEALING OR COURSE OF PERFORMANCE. BC FERRIES DOES NOT REPRESENT OR WARRANT THAT YOUR BC FERRIES ASSURED LOADING CARD WILL ALWAYS BE ACCESSIBLE OR ACCEPTED.

IN THE EVENT THAT BC FERRIES OR ITS AFFILIATES ARE FOUND LIABLE TO YOU, YOU SHALL ONLY BE ENTITLED TO RECOVER ACTUAL AND DIRECT DAMAGES AND SUCH DAMAGES SHALL NOT EXCEED THE LAST BALANCE HELD ON   YOUR BC FERRIES ASSURED LOADING CARD. BC FERRIES AND ITS AFFILIATES SHALL HAVE NO LIABILITY FOR ANY INCIDENTAL, INDIRECT OR CONSEQUENTIAL DAMAGES (INCLUDING WITHOUT LIMITATION LOSS OF PROFIT, REVENUE OR USE) ARISING OUT OF OR IN ANY WAY CONNECTED WITH THIS AGREEMENT, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE, WHETHER ACTIVE, PASSIVE OR IMPUTED), PRODUCT LIABILITY, STRICT LIABILITY OR OTHER THEORY, EVEN IF WE OR OUR AUTHORIZED REPRESENTATIVES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL BC FERRIES OR ITS AFFILIATES HAVE ANY LIABILITY FOR UNAUTHORIZED ACCESS TO, OR ALTERATION, THEFT OR DESTRUCTION OF A BC FERRIES ASSURED LOADING CARD THROUGH ACCIDENT, MISUSE, OR FRAUDULENT MEANS OR DEVICES BY YOU OR ANY THIRD PARTY, OR AS A RESULT OF ANY DELAY OR MISTAKE RESULTING FROM ANY CIRCUMSTANCES BEYOND OUR CONTROL.

The laws of certain provinces or other jurisdictions may not allow limitations on implied warranties, or the exclusion or limitation of certain damages. If these laws apply, some or all of the above disclaimers, exclusions, or limitations may not apply to you, and you may have rights in addition to those contained in this Agreement. In such jurisdiction, our liability is limited to the greatest extent permitted by law.

15.    Assignment.

We may assign all or part of this Agreement without such assignment being considered a change to the Agreement, and without notice to you. We will then be released from all liability. The assignee shall have the same rights and obligations as BC Ferries and shall agree in writing to be bound by the terms and conditions of this Agreement.
 
16.    Entire Agreement; Construction.

This Agreement is the complete and exclusive statement of agreement between you and British Columbia Ferry Services Inc., and supersedes and merges all prior proposals and all other agreements. In the event that any provision of this Agreement shall be determined to be illegal or unenforceable, that provision will be eliminated to the minimum extent necessary so that this Agreement shall otherwise remain in full force and effect and enforceable. Headings herein are for convenience of reference only and shall in no way affect interpretation of this Agreement.

The following terms and conditions (the “Terms”) form an agreement between you and British Columbia Ferry Services Inc. (“BC Ferries”) in relation to any travel, tour, transportation, accommodation or other product or service which you purchase through BC Ferries Vacations (a division of BC Ferries), whether by telephone, internet, in person at a BC Ferries Vacations travel centre, or otherwise (the “Services”).  

Please carefully and completely read these Terms, which (except as specifically noted below) apply to any and all Services provided by BC Ferries and/or third-party providers and which include important limitations, exclusions and disclaimers that affect your rights.

These Terms do not apply to transportation-only ferry bookings, which are not booked as part of a package. BC Ferries’ Rules & Requirements apply to such bookings.  

By using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Services.

 

General

“Southern Route” is in reference to any of the following BC Ferries sailing routes:
 
  • Campbell River – Quadra Island (Quathiaski Cove)
  • Comox (Little River) – Powell River (Westview)
  • Powell River (Saltery Bay) – Sunshine Coast (Earls Cove)
  • Vancouver (Horseshoe Bay) – Nanaimo (Departure Bay)
  • Vancouver (Horseshoe Bay) – Sunshine Coast (Langdale)
  • Vancouver (Tsawwassen) – Southern Gulf Islands
  • Vancouver (Tsawwassen) – Victoria (Swartz Bay)
  • Vancouver (Tsawwassen) – Nanaimo (Duke Point)
  • Victoria (Swartz Bay) – Salt Spring Island (Fulford Harbour)
  • Victoria (Swartz Bay) – Southern Gulf Islands
Vouchers issued by BC Ferries Vacations for travel packages are not interchangeable between routes. Vouchers are only valid on the route and date shown thereon.

Important: Changes and cancellations to bookings for Services which include travel on both Northern and Southern routes will be governed by the BC Ferries Vacation Packages Northern Routes change and cancellation terms.

Unless specifically stated otherwise, all prices are quoted in Canadian Dollars, are per person based on double occupancy and exclude taxes, fees and surcharges. Prices and Services are subject to availability and subject to change without notice. Please note the following:
 
  • BC Ferries reserves the right to pass on any additional costs charged by its suppliers.
 
  • BC Ferries strongly recommends that you purchase third-party cancellation insurance.
 
  • Prices for single, triple, quad and child occupancy are available upon request.
 
  • "Standard vehicle" rates are applicable to passenger vehicles up to 20 feet in length and 7 feet in height.
 
  • Reservations will not be honoured if you:
    • Arrive after the reservation check-in has closed, thirty (30) minutes prior to the scheduled departure.
    • Arrive before the reservation check-in has opened, more than sixty (60) minutes prior to the scheduled departure.
However, you may travel on the next available sailing (based on deck space availability).
 
  • Reservations will only be honoured for the specific sailing you reserve and are valid only for the type and length of vehicle specified by you. If your booked vehicle length differs by more than five (5) feet (1.5 metres) at check-in, your reservation will not be honoured.
 
  • Changes to your booked vehicle length, sailing date and time can be made by accessing your account online or by contacting our Customer Service Centre at 1-888-BC FERRY (1-888-223-3779 Ext. 3), 604-673-2440, or +8001BCFERRY (+80012233779) toll-free from outside Canada and the USA.
 
  • Check-in and check-out times vary by accommodation property and may not coincide with ferry arrival and departure times.
 
  • Refunds for unused Services are not provided in the event of your early departure from an accommodation property. If you decide to check out later than the specified check-out time, you are responsible to pay any additional charges that the property may impose directly to the property. 
 
  • BC Ferries will forward requests for specific room types, bedding configurations and other room requests to the booked property; however, BC Ferries cannot and does not guarantee that the third-party supplier will comply with the request. 
 
  • BC Ferries makes reasonable efforts to ensure that the property information described in marketing and other materials related to the Services is current and accurate; however, BC Ferries will not be responsible for changes to a property, its services or any inconveniences resulting from construction or maintenance at a property. 
 

Taxes and Fees

You agree that at the time of booking you will be charged any taxes, fees, surcharges or tariffs applicable to your reservation, including Goods and Services Tax, Provincial Sales Tax, Hotel Room Tax, Municipal and Regional District Tax (MRDT), and any other taxes as applicable. Fuel surcharges may also be charged in certain circumstances.
 

Booking Cancellations, Changes to Services, No-Shows

If you wish to cancel or change an existing travel package reservation made through BC Ferries Vacations or if you do not use the Services or products provided by BC Ferries or third party providers at the time for which they are reserved, the following apply:

Cancellations for packages including travel on a Southern Route: 
 
  • Campbell River – Quadra Island (Quathiaski Cove)
  • Comox (Little River) – Powell River (Westview)
  • Powell River (Saltery Bay) – Sunshine Coast (Earls Cove)
  • Powell River (Westview) – Comox (Little River)
  • Vancouver (Horseshoe Bay) – Nanaimo (Departure Bay)
  • Vancouver (Horseshoe Bay) – Sunshine Coast (Langdale)
  • Vancouver (Tsawwassen) – Southern Gulf Islands
  • Vancouver (Tsawwassen) – Victoria (Swartz Bay)
  • Vancouver (Tsawwassen) – Nanaimo (Duke Point)
  • Victoria (Swartz Bay) – Salt Spring Island (Fulford Harbour)
  • Victoria (Swartz Bay) – Southern Gulf Islands

i.    If you cancel seventy-two (72) or more hours prior to the date of the reserved Services, BC Ferries will refund the money you paid for the Services, less a $25 processing fee per booking.

ii.    If you cancel fewer than seventy-two (72) hours prior to the date of the reserved Services, none of the money you paid for the Services will be refunded.

iii.    Notwithstanding the foregoing, no refund will be provided if BC Ferries’ contractual obligations with a third party supplier providing the Services do not allow BC Ferries to obtain a refund of sums paid by BC Ferries to the third party supplier on your behalf. Additional terms and conditions may apply to group bookings of parties of ten (10) or more.

Changes to packages including travel on a Southern Route:

i.    Subject to subsection (i), if you change your Southern Route package reserved services seventy-two (72) or more hours prior to the date of the reserved Services, BC Ferries will charge you a $25 processing fee per booking to make the change.

ii.    You may not make any changes to reserved Southern Route Services fewer than seventy-two (72) hours prior to the date of the reserved Services. You may make changes to your sailing only up until one (1) hour before the scheduled departure. BC Ferries will charge you a $5 change fee to make changes to your sailing only.

iii.    If you arrive at the terminal before the required time to claim your reservation on the date of the reserved Services, you may travel on the next available sailing based on deck space availability.

iv.    If you arrive at the terminal after the required time to claim your reservation on the date of the reserved Services, you may travel on the next available sailing based on deck space availability.

v.    If you choose to travel on a different date than that of the reserved Services without contacting BC Ferries Vacations to modify your sailing time in advance, none of the money you paid for the transportation Services will be refunded.

vi.    If you are travelling on an open ticket, your voucher is valid for any sailing on the specific route and date of the Services, based on order of arrival at the terminal and deck space availability.

vii.    In the event that the number of vehicles which or individuals who wish to use the booked Services is greater than the number reserved, BC Ferries and/or its third party supplier will charge you for any additional vehicles and/or individuals. In addition, you acknowledge that any vehicles or individuals exceeding the number reserved are not entitled to use the reserved Services and will only be provided with Services based on availability.

viii.    In the event that the price of the changed Services is greater than the price of the reserved Services, you will be responsible for any additional charges which occur because of the requested change.

ix.    Notwithstanding the foregoing, changes to reservations may not be possible if BC Ferries’ contractual obligations with a third party supplier providing the Services (or that supplier’s policies) do not allow for changes at the time the request is made. Additional terms and conditions may apply to group bookings.

Exceptions:

Certain travel product and service offers, including promotional offers have additional limitations, exclusions, restrictions and/or fees specific to them and, in those cases, third party operator policies apply in addition to the cancellation and change terms set out above. If applicable, see “BC Ferries Vacations Exceptions Policies” on your booking confirmation for specific policies which apply to your booking.

No-Shows:

Subject to any permitted cancellations or changes as set out above, if you do not use the Services at the time for which they are reserved, none of the money you paid for the Services will be refunded.
 

Documentation, Insurance, Incidental Expenses

You are solely responsible for determining what documentation you may be required to present in connection with your use of the Services, including a passport or other identification, visas or certificates.  BC Ferries will not be responsible for any loss you incur as a result of not carrying the required travel documentation. In addition, BC Ferries will not be responsible if you are refused entry into any country, state, province or other jurisdiction for any reason. You are solely responsible for the purchase of any travel or other insurance in connection with your use of the Services. Insurance is not included in the Services. Unless otherwise confirmed in writing by BC Ferries to you, you are solely responsible for the cost and payment of expenses that are incidental to the Services, such as phone charges, internet charges, gratuities, airport transfers and other fees, charges and incidental expenses.
 

No Warranties and No Liability

YOU ACKNOWLEDGE AND AGREE THAT THE SERVICES ARE PROVIDED ON AN “AS IS”, “WITHOUT ANY WARRANTIES”, AND “WITHOUT ANY LIABILITY” BASIS.  THE PARTIES TO THESE TERMS ACKNOWLEDGE AND AGREE THAT THIS LIMITATION OF LIABILITY IS REASONABLE IN THE CIRCUMSTANCES.

BC FERRIES AND ITS AFFILIATES DO NOT GUARANTEE THE QUALITY, ACCURACY, COMPLETENESS, OR TIMELINESS OF THE SERVICES OR MATERIALS RELATED TO THE SERVICES, WHICH MATERIALS MAY CONTAIN ERRORS, INCLUDING PRICING ERRORS AND ERRORS IN THE DESCRIPTION OF THE TRAVEL PRODUCTS. BC FERRIES EXPRESSLY RESERVES THE RIGHT TO CORRECT ANY PRICING ERRORS ON PENDING RESERVATIONS.  THIS RIGHT APPLIES REGARDLESS OF WHETHER YOUR RESERVATION HAS BEEN CONFIRMED OR YOU HAVE BEEN CHARGED FOR IT. 

IN THE CASE OF A PRICING ERROR, BC FERRIES WILL OFFER YOU THE OPTION TO KEEP YOUR PENDING RESERVATION AT THE CORRECT PRICE OR BC FERRIES WILL CANCEL YOUR RESERVATION WITHOUT PENALTY. BC FERRIES AND ITS AFFILIATES DISCLAIM AND EXCLUDE TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALL WARRANTIES, REPRESENTATIONS, AND CONDITIONS REGARDING USE OF THE SERVICES, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, WHETHER EXPRESS OR IMPLIED AND WHETHER ARISING FROM A COURSE OF DEALING, USAGE, OR TRADE PRACTICE. BC FERRIES AND ITS AFFILIATES ARE NOT RESPONSIBLE FOR ANY INJURY, ACCIDENTS OR DEATH, OR INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES WHATSOEVER ARISING OUT OF OR IN CONNECTION WITH THE USE OR THE AVAILABILITY OF THE SERVICES, INCLUDING WITHOUT LIMITATION ANY BUSINESS INTERRUPTION, LOSS OF USE, LOST DATA, LOST PROFITS, FAILURE TO REALIZE EXPECTED SAVINGS, OR ANY PECUNIARY LOSS, WHETHER IN AN ACTION OF CONTRACT, CIVIL LIABILITY, NEGLIGENCE, OR OTHER TORTIOUS ACTION, EVEN IF BC FERRIES OR ITS AFFILIATES HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGES OR SUCH DAMAGES ARE REASONABLY FORESEEABLE. 

THE THIRD-PARTY SUPPLIERS PROVIDING SERVICES ARE INDEPENDENT CONTRACTORS AND NOT AGENTS OR EMPLOYEES OF BC FERRIES OR ANY OF ITS AFFILIATES.  BC FERRIES AND ITS AFFILIATES ARE NOT LIABLE FOR THE ACTS, ERRORS, OMISSIONS, REPRESENTATIONS, WARRANTIES, BREACHES OR NEGLIGENCE OF ANY SUCH THIRD-PARTY SUPPLIERS OR AGENTS OF THIRD-PARTY SUPPLIERS OR FOR ANY PERSONAL INJURIES, DEATH, PROPERTY DAMAGE, OR OTHER DAMAGES OR EXPENSES RESULTING THEREFROM.  THIRD-PARTY SUPPLIERS MAY IMPOSE TARIFFS AND CONDITIONS THAT ARE UNKNOWN TO BC FERRIES. BC FERRIES AND ITS AFFILIATES WILL HAVE NO LIABILITY AND WILL MAKE NO REFUND IN THE EVENT OF ANY LOSS OR DAMAGE OF BAGGAGE OR OTHER PROPERTY, DELAY, CANCELLATION, OVERBOOKING, STRIKE, FORCE MAJEURE OR OTHER CAUSES BEYOND ITS DIRECT CONTROL AND WILL HAVE NO RESPONSIBILITY FOR ANY ADDITIONAL EXPENSE, OMISSIONS, DELAYS, RE-ROUTING OR FOR ANY ACTS OF ANY GOVERNMENT OR AUTHORITY. WHERE THE LIMITATION OR THE EXCLUSION OF CERTAIN TYPES OF DAMAGES IS NOT ALLOWED, THE LIMITATIONS, EXCLUSIONS, AND DISCLAIMERS IN THESE TERMS WILL NOT APPLY ONLY IF AND TO THE EXTENT THAT THE LAWS OF A COMPETENT JURISDICTION REQUIRE LIABILITIES BEYOND AND/OR DESPITE THE LIMITATIONS, EXCLUSIONS AND DISCLAIMERS IN THESE TERMS.  

“FORCE MAJEURE” MEANS AN EVENT THAT IS BEYOND THE REASONABLE CONTROL AND WITHOUT THE FAULT OF BC FERRIES OR A THIRD-PARTY SUPPLIER AND INCLUDES, BUT IS NOT LIMITED TO, ACTS OF GOD, CHANGES IN THE LAWS OF BRITISH COLUMBIA OR CANADA, GOVERNMENTAL RESTRICTIONS OR CONTROL ON IMPORTS, EXPORTS OR FOREIGN EXCHANGE, WARS (DECLARED OR UNDECLARED), FIRES, FLOODS, STORMS, ACCIDENTS TO OR BREAKDOWN OF VESSELS, MACHINERY OR EQUIPMENT, EPIDEMICS, QUARANTINE RESTRICTIONS, STRIKES (INCLUDING ILLEGAL WORK STOPPAGES OR SLOWDOWNS), LOCKOUTS, LABOUR SHORTAGES, FREIGHT EMBARGOES, POWER FAILURES OR A REFUSAL OF ANY THIRD-PARTY PROVIDER TO PROVIDE THE SERVICES.
 

Limit on Damages and Claims

NOTWITHSTANDING ANY OTHER PROVISIONS OF THESE TERMS, YOU ACKNOWLEDGE AND AGREE THAT UNDER NO CIRCUMSTANCES WILL THE AGGREGATE OF BC FERRIES’ LIABILITY IN RESPECT OF THE SERVICES EXCEED THE CHARGES ACTUALLY PAID BY YOU FOR THE SERVICES OR, IN THE EVENT THAT YOU HAVE NOT PAID ANY CHARGES IN RESPECT OF THE SERVICES, A MAXIMUM OF CDN $100. ANY CAUSE OF ACTION THAT YOU MAY HAVE ARISING OUT OF OR RELATED TO THE SERVICES MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES.  OTHERWISE, UNLESS AND TO THE EXTENT SUCH LIMITATION IS PROHIBITED BY APPLICABLE LAWS, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.
 

Indemnity

You hereby agree to indemnify and keep BC Ferries, its partners, affiliates and associates and their respective directors, officers, employees and agents indemnified fully against all liabilities, damages, claims, losses, costs and expenses of any kind or nature, which they may incur to a third party or you as a result of your breach of the provisions of these Terms, your negligence or wilful misconduct, your misuse of the Services or your violation of any law or the rights of a third party.
 

Applicable Law and Jurisdiction

These Terms are governed by the laws of British Columbia and the laws of Canada that apply in British Columbia. 
 

Dispute Resolution

Any dispute arising out of or in connection with your use of the Services will be referred to and finally resolved by arbitration administered by the BC International Arbitration Centre pursuant to its rules. The seat of the arbitration will be Vancouver, British Columbia. If for any reason this arbitration clause is deemed inapplicable or invalid, you waive, to the fullest extent allowed by law, any claim to recover punitive or exemplary damages and any right to pursue any claim on a class or consolidated basis or in a representative capacity.
 

Separate Terms

i.    Separate terms and conditions will apply to Services provided by third-party suppliers even if they are purchased through BC Ferries. You acknowledge that some third-party suppliers may require you to agree to their terms and conditions (including liability waivers) before you can use or participate in the Services that they offer. You agree to comply with any separate terms and conditions imposed on you and acknowledge that failure to do so may result in the cancellation of reservations, denial of Services, loss of pre-paid amounts or deposits, or the exercise of other rights BC Ferries or third-party suppliers may have.

ii.    Separate terms and conditions also apply to your use, if any, of the BC Ferries Vacations website at bcferries.com/vacations, which terms and conditions may be reviewed at that website.
 

Changes to Terms

BC Ferries reserves the right to change these Terms at any time by posting amended Terms on bcferries.com/vacations. The amended Terms will be effective immediately, and by continuing to use the Website and/or the Services you agree to be bound by the amended Terms.  We encourage you to periodically revisit this page to review the Terms as modified from time to time.
 

Collection, Use and Disclosure of Personal Information

BC Ferries collects, uses, and discloses your personal information as authorized by the Freedom of Information and Protection of Privacy Act and as set out in the BC Ferries website privacy statement (the “Privacy Statement”). The Privacy Statement is incorporated into these Terms and is available at bcferries.com/privacy-statement.

BC Ferries collects, uses and discloses your personal information for the purpose of vacation planning and reservation services. By providing personal information to BC Ferries, you consent to the use and disclosure of personal information as set out in these Terms and in accordance with the Privacy Statement. By purchasing Services, you are expressly agreeing that BC Ferries may provide your personal information to third-party suppliers related to the Services that you purchased.  If you have questions about the collection, use or disclosure of personal information for the stated purpose, contact BC Ferries at 1-888-223-3779, ext 3.
 

Access to Services

You must be a minimum of nineteen years old to reserve or purchase any Services, subject to minimum age restrictions imposed by individual providers of the Services.  BC Ferries may without notice terminate or suspend your access to the Services and to its website(s) for any reason, including if you use the Services in any manner that is prohibited by these Terms. If BC Ferries provides you with notice of termination or suspension of your access to any BC Ferries website and you subsequently book any Services, BC Ferries may cancel those bookings for Services without liability.
 

Miscellaneous

You acknowledge that your breach (or attempt or threat to breach) of these Terms will cause irreparable harm to BC Ferries and that BC Ferries will have a right to seek an appropriate order from a court of competent jurisdiction restraining you from any further breaches (or attempted or threatened breaches). If any provision of these Terms is determined by any court of competent jurisdiction to be illegal or unenforceable, that provision will be severed from these Terms and the remaining provisions will continue in full force and effect. These Terms constitute the entire agreement between you and BC Ferries with respect to the subject matter hereof and cancels and supersedes any prior understandings and agreements between us with respect thereto. There are no representations, warranties, terms, conditions, undertakings or collateral agreements, express, implied or statutory, between the parties other than as expressly set forth in these Terms. The Privacy Statement, BC Ferries’ Conditions of Carriage, available at bcferries.com/terms-and-conditions/conditions-of-carriage and the BC Ferries Rules & Requirements, available at bcferries.com/terms-and-conditions/rules-and-requirements as well as any other policy or rules that apply to any Services, as amended from time to time, are incorporated by reference and are part of these Terms.

The following terms and conditions (the “Terms”) form an agreement between you and British Columbia Ferry Services Inc. (“BC Ferries”) in relation to any travel, tour, transportation, accommodation or other product or service which you purchase through BC Ferries Vacations (a division of BC Ferries), whether by telephone, internet, in person at a BC Ferries Vacations travel centre, or otherwise (the “Services”).  

Please carefully and completely read these Terms, which (except as specifically noted below) apply to any and all Services provided by BC Ferries and/or third-party providers and which include important limitations, exclusions and disclaimers that affect your rights.

These Terms do not apply to transportation-only ferry bookings, which are not booked as part of a package. BC Ferries’ Rules & Requirements apply to such bookings.  

By using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Services.

 

General

“Northern Route” is in reference to any of the following BC Ferries sailing routes: 
 
  • Bella Coola – Port Hardy (Bear Cove)
  • Central Coast Connector Service – Bella Bella, Ocean Falls, Bella Coola and Shearwater
  • Ocean Falls, Bella Coola & Shearwater
  • Graham Island (Skidegate) – Moresby Island (Alliford Bay)
  • Graham Island (Skidegate) – Prince Rupert
  • Port Hardy (Bear Cove) – Prince Rupert. 
Vouchers issued by BC Ferries Vacations for travel packages are not interchangeable between routes. Vouchers are only valid on the route and date shown thereon.

Important: Changes and cancellations to bookings for Services which include travel on both Northern and Southern routes will be governed by the BC Ferries Vacation Packages Northern Routes change and cancellation terms.

Unless specifically stated otherwise, all prices are quoted in Canadian Dollars, are per person based on double occupancy and exclude taxes, fees and surcharges. Prices and Services are subject to availability and subject to change without notice. Please note the following:
 
  • BC Ferries reserves the right to pass on any additional costs charged by its suppliers.
 
  • BC Ferries strongly recommends that you purchase third-party cancellation insurance.
 
  • Prices for single, triple, quad and child occupancy are available upon request.
 
  • "Standard vehicle" rates are applicable to passenger vehicles up to 20 feet in length and 7 feet in height
 
  • Reservations will not be honoured if you:
    • Arrive after the reservation check-in has closed, ninety (90) minutes prior to the scheduled departure.
    • Arrive before the reservation check-in has opened, more than one hundred and twenty (120) minutes prior to the scheduled departure.
However, you may travel on the next available sailing (based on deck space availability).
 
  • Reservations will only be honoured for the specific sailing you reserve and are valid only for the type and length of vehicle specified by you. If your booked vehicle length differs by more than five (5) feet (1.5 metres) at check-in, your reservation will not be honoured.
 
  • Changes to your booked vehicle length, sailing date and time can be made by accessing your account online or by contacting our Customer Service Centre at 1-888-BC FERRY (1-888-223-3779 ext. 3), 604-673-2440, or +8001BCFERRY (+80012233779) toll-free from outside Canada and the USA.
 
  • Check-in and check-out times vary by accommodation property and may not coincide with ferry arrival and departure times.
 
  • Refunds for unused Services are not provided in the event of your early departure from an accommodation property. If you decide to check out later than the specified check-out time, you are responsible to pay any additional charges that the property may impose directly to the property. 
 
  • BC Ferries will forward requests for specific room types, bedding configurations and other room requests to the booked property; however, BC Ferries cannot and does not guarantee that the third-party supplier will comply with the request. 
 
  • BC Ferries makes reasonable efforts to ensure that the property information described in marketing and other materials related to the Services is current and accurate; however, BC Ferries will not be responsible for changes to a property, its services or any inconveniences resulting from construction or maintenance at a property. 
 

Taxes and Fees

You agree that at the time of booking you will be charged any taxes, fees, surcharges or tariffs applicable to your reservation, including Goods and Services Tax, Provincial Sales Tax, Hotel Room Tax, Municipal and Regional District Tax (MRDT), and any other taxes as applicable. Fuel surcharges may also be charged in certain circumstances.
 

Booking Cancellations, Changes to Services, No-Shows

If you wish to cancel or change an existing travel package reservation made through BC Ferries Vacations or if you do not use the Services or products provided by BC Ferries or third party providers at the time for which they are reserved, the following apply:

Cancellations for packages including travel on a Northern Route: 
 
  • Bella Coola – Port Hardy (Bear Cove)
  • Central Coast Connector Service – Bella Bella, Ocean Falls, Bella Coola and Shearwater
  • Graham Island (Skidegate) – Moresby Island (Alliford Bay)
  • Graham Island (Skidegate) – Prince Rupert
  • Port Hardy (Bear Cove) – Prince Rupert 

i.    If you cancel seven (7) or more full days prior to the date of the reserved Services, BC Ferries will refund the money you paid for the Services, less a $100 processing fee per booking.

ii.    If you cancel fewer than seven (7) full days prior to the date of the reserved Services, none of the money you paid for the Services will be refunded.

iii.    Notwithstanding the foregoing, no refund will be provided if BC Ferries’ contractual obligations with a third party supplier providing the Services do not allow BC Ferries to obtain a refund of sums paid by BC Ferries to the third party supplier on your behalf. Additional terms and conditions may apply to group bookings of parties of ten (10) or more.

iv.    Haida Gwaii Escape Packages: If you cancel more than ninety (90) full days prior to the date of the reserved Services, BC Ferries will refund the money you paid for the Services less a $400 cancellation fee; if you cancel between sixty (60) and ninety (90) full days prior to the date of the reserved Services, BC Ferries will refund 50% of the money you paid for the Services; if you cancel within fifty-nine (59) full days prior to the date of the reserved Services, none of the money you paid for the Services will be refunded. 

Changes to packages including travel on a Northern Route:

i.    Subject to subsection (i), if you change your Northern Route package reserved services seven (7) or more full days prior to the date of the reserved Services, BC Ferries will charge you a $100 processing fee per booking to make the change.

ii.    If you change the date of your Northern Route package reserved accommodation services seven (7) or more full days prior to the original date of the reserved Services, BC Ferries will charge you a $100 change fee per booking to make the change.

iii.    You may not make any changes to reserved Northern Services fewer than seven (7) full days prior to the date of the reserved Services.

iv.    If you arrive at the terminal before the required time to claim your reservation on the date of the reserved Services, you may travel on the next available sailing based on deck space availability.

v.    If you arrive at the terminal after the required time to claim your reservation on the date of the reserved Services, you may travel on the next available sailing based on deck space availability.

vi.    If you choose to travel on a different date than that of the reserved Services without contacting BC Ferries Vacations to modify your sailing time in advance, none of the money you paid for the transportation Services will be refunded.

vii.    If you are travelling on an open ticket, your voucher is valid for any sailing on the specific route and date of the Services, based on order of arrival at the terminal and deck space availability.

viii.    In the event that the number of vehicles which or individuals who wish to use the booked Services is greater than the number reserved, BC Ferries and/or its third party supplier will charge you for any additional vehicles and/or individuals. In addition, you acknowledge that any vehicles or individuals exceeding the number reserved are not entitled to use the reserved Services and will only be provided with Services based on availability.

ix.    In the event that the price of the changed Services is greater than the price of the reserved Services, you will be responsible for any additional charges which occur because of the requested change.

x.    Notwithstanding the foregoing, changes to reservations may not be possible if BC Ferries’ contractual obligations with a third party supplier providing the Services (or that supplier’s policies) do not allow for changes at the time the request is made. Additional terms and conditions may apply to group bookings.

Exceptions: 

Certain travel product and service offers, including promotional offers have additional limitations, exclusions, restrictions and/or fees specific to them and, in those cases, third party operator policies apply in addition to the cancellation and change terms set out above. If applicable, see “BC Ferries Vacations Exceptions Policies” on your booking confirmation for specific policies which apply to your booking.

No-Shows:

Subject to any permitted cancellations or changes as set out above, if you do not use the Services at the time for which they are reserved, none of the money you paid for the Services will be refunded.
 

Documentation, Insurance, Incidental Expenses

You are solely responsible for determining what documentation you may be required to present in connection with your use of the Services, including a passport or other identification, visas or certificates.  BC Ferries will not be responsible for any loss you incur as a result of not carrying the required travel documentation. In addition, BC Ferries will not be responsible if you are refused entry into any country, state, province or other jurisdiction for any reason. You are solely responsible for the purchase of any travel or other insurance in connection with your use of the Services. Insurance is not included in the Services. Unless otherwise confirmed in writing by BC Ferries to you, you are solely responsible for the cost and payment of expenses that are incidental to the Services, such as phone charges, internet charges, gratuities, airport transfers and other fees, charges and incidental expenses.
 

No Warranties and No Liability

YOU ACKNOWLEDGE AND AGREE THAT THE SERVICES ARE PROVIDED ON AN “AS IS”, “WITHOUT ANY WARRANTIES”, AND “WITHOUT ANY LIABILITY” BASIS.  THE PARTIES TO THESE TERMS ACKNOWLEDGE AND AGREE THAT THIS LIMITATION OF LIABILITY IS REASONABLE IN THE CIRCUMSTANCES.

BC FERRIES AND ITS AFFILIATES DO NOT GUARANTEE THE QUALITY, ACCURACY, COMPLETENESS, OR TIMELINESS OF THE SERVICES OR MATERIALS RELATED TO THE SERVICES, WHICH MATERIALS MAY CONTAIN ERRORS, INCLUDING PRICING ERRORS AND ERRORS IN THE DESCRIPTION OF THE TRAVEL PRODUCTS. BC FERRIES EXPRESSLY RESERVES THE RIGHT TO CORRECT ANY PRICING ERRORS ON PENDING RESERVATIONS.  THIS RIGHT APPLIES REGARDLESS OF WHETHER YOUR RESERVATION HAS BEEN CONFIRMED OR YOU HAVE BEEN CHARGED FOR IT.

BC FERRIES AND ITS AFFILIATES DISCLAIM AND EXCLUDE TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALL WARRANTIES, REPRESENTATIONS, AND CONDITIONS REGARDING USE OF THE SERVICES, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, WHETHER EXPRESS OR IMPLIED AND WHETHER ARISING FROM A COURSE OF DEALING, USAGE, OR TRADE PRACTICE. BC FERRIES AND ITS AFFILIATES ARE NOT RESPONSIBLE FOR ANY INJURY, ACCIDENTS OR DEATH, OR INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES WHATSOEVER ARISING OUT OF OR IN CONNECTION WITH THE USE OR THE AVAILABILITY OF THE SERVICES, INCLUDING WITHOUT LIMITATION ANY BUSINESS INTERRUPTION, LOSS OF USE, LOST DATA, LOST PROFITS, FAILURE TO REALIZE EXPECTED SAVINGS, OR ANY PECUNIARY LOSS, WHETHER IN AN ACTION OF CONTRACT, CIVIL LIABILITY, NEGLIGENCE, OR OTHER TORTIOUS ACTION, EVEN IF BC FERRIES OR ITS AFFILIATES HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGES OR SUCH DAMAGES ARE REASONABLY FORESEEABLE. 

THE THIRD-PARTY SUPPLIERS PROVIDING SERVICES ARE INDEPENDENT CONTRACTORS AND NOT AGENTS OR EMPLOYEES OF BC FERRIES OR ANY OF ITS AFFILIATES.  BC FERRIES AND ITS AFFILIATES ARE NOT LIABLE FOR THE ACTS, ERRORS, OMISSIONS, REPRESENTATIONS, WARRANTIES, BREACHES OR NEGLIGENCE OF ANY SUCH THIRD-PARTY SUPPLIERS OR AGENTS OF THIRD-PARTY SUPPLIERS OR FOR ANY PERSONAL INJURIES, DEATH, PROPERTY DAMAGE, OR OTHER DAMAGES OR EXPENSES RESULTING THEREFROM.  THIRD-PARTY SUPPLIERS MAY IMPOSE TARIFFS AND CONDITIONS THAT ARE UNKNOWN TO BC FERRIES. WHERE THE LIMITATION OR THE EXCLUSION OF CERTAIN TYPES OF DAMAGES IS NOT ALLOWED, THE LIMITATIONS, EXCLUSIONS, AND DISCLAIMERS IN THESE TERMS WILL NOT APPLY ONLY IF AND TO THE EXTENT THAT THE LAWS OF A COMPETENT JURISDICTION REQUIRE LIABILITIES BEYOND AND/OR DESPITE THE LIMITATIONS, EXCLUSIONS AND DISCLAIMERS IN THESE TERMS.  

“FORCE MAJEURE” MEANS AN EVENT THAT IS BEYOND THE REASONABLE CONTROL AND WITHOUT THE FAULT OF BC FERRIES OR A THIRD-PARTY SUPPLIER AND INCLUDES, BUT IS NOT LIMITED TO, ACTS OF GOD, CHANGES IN THE LAWS OF BRITISH COLUMBIA OR CANADA, GOVERNMENTAL RESTRICTIONS OR CONTROL ON IMPORTS, EXPORTS OR FOREIGN EXCHANGE, WARS (DECLARED OR UNDECLARED), FIRES, FLOODS, STORMS, ACCIDENTS TO OR BREAKDOWN OF VESSELS, MACHINERY OR EQUIPMENT, EPIDEMICS, QUARANTINE RESTRICTIONS, STRIKES (INCLUDING ILLEGAL WORK STOPPAGES OR SLOWDOWNS), LOCKOUTS, LABOUR SHORTAGES, FREIGHT EMBARGOES, POWER FAILURES OR A REFUSAL OF ANY THIRD-PARTY PROVIDER TO PROVIDE THE SERVICES.
 

Limit on Damages and Claims

NOTWITHSTANDING ANY OTHER PROVISIONS OF THESE TERMS, YOU ACKNOWLEDGE AND AGREE THAT UNDER NO CIRCUMSTANCES WILL THE AGGREGATE OF BC FERRIES’ LIABILITY IN RESPECT OF THE SERVICES EXCEED THE CHARGES ACTUALLY PAID BY YOU FOR THE SERVICES OR, IN THE EVENT THAT YOU HAVE NOT PAID ANY CHARGES IN RESPECT OF THE SERVICES, A MAXIMUM OF CDN $100. ANY CAUSE OF ACTION THAT YOU MAY HAVE ARISING OUT OF OR RELATED TO THE SERVICES MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES.  OTHERWISE, UNLESS AND TO THE EXTENT SUCH LIMITATION IS PROHIBITED BY APPLICABLE LAWS, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.
 

Indemnity

You hereby agree to indemnify and keep BC Ferries, its partners, affiliates and associates and their respective directors, officers, employees and agents indemnified fully against all liabilities, damages, claims, losses, costs and expenses of any kind or nature, which they may incur to a third party or you as a result of your breach of the provisions of these Terms, your negligence or wilful misconduct, your misuse of the Services or your violation of any law or the rights of a third party.
 

Applicable Law and Jurisdiction

These Terms are governed by the laws of British Columbia and the laws of Canada that apply in British Columbia. 
 

Dispute Resolution

Any dispute arising out of or in connection with your use of the Services will be referred to and finally resolved by arbitration administered by the BC International Arbitration Centre pursuant to its rules. The seat of the arbitration will be Vancouver, British Columbia. If for any reason this arbitration clause is deemed inapplicable or invalid, you waive, to the fullest extent allowed by law, any claim to recover punitive or exemplary damages and any right to pursue any claim on a class or consolidated basis or in a representative capacity.
 

Separate Terms

i.    Separate terms and conditions will apply to Services provided by third-party suppliers even if they are purchased through BC Ferries. You acknowledge that some third-party suppliers may require you to agree to their terms and conditions (including liability waivers) before you can use or participate in the Services that they offer. You agree to comply with any separate terms and conditions imposed on you and acknowledge that failure to do so may result in the cancellation of reservations, denial of Services, loss of pre-paid amounts or deposits, or the exercise of other rights BC Ferries or third-party suppliers may have.

Changes to Terms

BC Ferries reserves the right to change these Terms at any time by posting amended Terms on bcferries.com/vacations. The amended Terms will be effective immediately, and by continuing to use the Website and/or the Services you agree to be bound by the amended Terms.  We encourage you to periodically revisit this page to review the Terms as modified from time to time.
 

Collection, Use and Disclosure of Personal Information

BC Ferries collects, uses, and discloses your personal information as authorized by the Freedom of Information and Protection of Privacy Act and as set out in the BC Ferries website privacy statement (the “Privacy Statement”). The Privacy Statement is incorporated into these Terms and is available at bcferries.com/privacy-statement.

BC Ferries collects, uses and discloses your personal information for the purpose of vacation planning and reservation services. By providing personal information to BC Ferries, you consent to the use and disclosure of personal information as set out in these Terms and in accordance with the Privacy Statement. By purchasing Services, you are expressly agreeing that BC Ferries may provide your personal information to third-party suppliers related to the Services that you purchased.  If you have questions about the collection, use or disclosure of personal information for the stated purpose, contact BC Ferries at 1-888-223-3779, ext 3.
 

Access to Services

You must be a minimum of nineteen years old to reserve or purchase any Services, subject to minimum age restrictions imposed by individual providers of the Services.  BC Ferries may without notice terminate or suspend your access to the Services and to its website(s) for any reason, including if you use the Services in any manner that is prohibited by these Terms. If BC Ferries provides you with notice of termination or suspension of your access to any BC Ferries website and you subsequently book any Services, BC Ferries may cancel those bookings for Services without liability.
 

Miscellaneous

You acknowledge that your breach (or attempt or threat to breach) of these Terms will cause irreparable harm to BC Ferries and that BC Ferries will have a right to seek an appropriate order from a court of competent jurisdiction restraining you from any further breaches (or attempted or threatened breaches). If any provision of these Terms is determined by any court of competent jurisdiction to be illegal or unenforceable, that provision will be severed from these Terms and the remaining provisions will continue in full force and effect. These Terms constitute the entire agreement between you and BC Ferries with respect to the subject matter hereof and cancels and supersedes any prior understandings and agreements between us with respect thereto. There are no representations, warranties, terms, conditions, undertakings or collateral agreements, express, implied or statutory, between the parties other than as expressly set forth in these Terms. General

Unless specifically stated otherwise, all prices are quoted in Canadian dollars, are per person and exclude taxes, fees and surcharges. Prices and Activities are subject to availability and subject to change without notice. Please note the following:
 
  • BC Ferries reserves the right to pass on any additional costs charged by its suppliers.
  • Where applicable, BC Ferries strongly recommends that you purchase third-party cancellation insurance.
  • BC Ferries makes reasonable efforts to ensure that the information described in marketing and other materials related to the Activities is current and accurate; however, BC Ferries will not be responsible for changes to an Activity provider, its offered Activities or any inconveniences resulting from construction or maintenance at a property or Activity. 
 

Taxes and Fees

You agree that at the time of booking you will be charged any taxes, fees, surcharges or tariffs applicable to your reservation, including Goods and Services Tax, Provincial Sales Tax, Hotel Room Tax, Municipal and Regional District Tax (MRDT), and any other taxes as applicable. Fuel surcharges may also be charged in certain circumstances.
 

Booking Cancellations, Changes to Activities, No Shows

If you wish to cancel or change an existing Activity booking made through BC Ferries Vacations or if you do not use the Activities or services provided by BC Ferries or third party providers at the time for which they are reserved, the following apply:

Cancellations of Activity Bookings: 
 
  1. If you cancel seventy-two (72) or more hours prior to the date of the reserved Activity(ies), BC Ferries will refund the money you paid for the Activity(ies), less a $25 processing fee per booking.
     
  2. If you cancel fewer than seventy-two (72) hours prior to the date of the reserved Activity(ies), none of the money you paid for the Activity(ies) will be refunded.
     
  3. Notwithstanding the foregoing, no refund will be provided if BC Ferries’ contractual obligations with a third party supplier providing the Activity(ies) do not allow BC Ferries to obtain a refund of sums paid by BC Ferries to the third party supplier on your behalf. Additional terms and conditions may apply to group bookings of parties of ten (10) or more.
Changes to Activity Bookings:
 
  1. Subject to subsection (i), if you change your Activity(ies) booking seventy-two (72) or more hours prior to the date of the reserved Activity(ies), BC Ferries will charge you a $25 processing fee per booking to make the change.
     
  2. You may not make any changes to Activity(ies) bookings fewer than seventy-two (72) hours prior to the date of the reserved Activity(ies). 
     
  3. In the event that the price of the changed Activity(ies) is greater than the price of the reserved Activity(ies), you will be responsible for any additional charges which occur because of the requested change.
     
  4. Notwithstanding the foregoing, changes to reservations may not be possible if BC Ferries’ contractual obligations with a third party supplier providing the Activity(ies) (or that supplier’s policies) do not allow for changes at the time the request is made. Additional terms and conditions may apply to group bookings. 

No-Shows:

Subject to any permitted cancellations or changes as set out above, if you do not use the Activity(ies) at the time for which they are reserved, none of the money you paid for the Activity(ies) will be refunded.
 

Documentation, Insurance, Incidental Expenses

You are solely responsible for determining what documentation you may be required to present in connection with your use of the Activities, including a passport or other identification, visas or certificates.  BC Ferries will not be responsible for any loss you incur as a result of not carrying the required travel documentation. In addition, BC Ferries will not be responsible if you are refused entry into any country, state, province or other jurisdiction for any reason. You are solely responsible for the purchase of any travel or other insurance in connection with your use of the Activities. Insurance is not included in the price of Activities. Unless otherwise confirmed in writing by BC Ferries to you, you are solely responsible for the cost and payment of expenses that are incidental to the Activities, such as non-included transportation, phone charges, internet charges, gratuities, airport transfers and other fees, charges and incidental expenses.
 

No Warranties and No Liability

YOU ACKNOWLEDGE AND AGREE THAT THE ACTIVITIES ARE PROVIDED ON AN “AS IS”, “WITHOUT ANY WARRANTIES”, AND “WITHOUT ANY LIABILITY” BASIS.  THE PARTIES TO THESE TERMS ACKNOWLEDGE AND AGREE THAT THIS LIMITATION OF LIABILITY IS REASONABLE IN THE CIRCUMSTANCES.

BC FERRIES AND ITS AFFILIATES DO NOT GUARANTEE THE QUALITY, ACCURACY, COMPLETENESS, OR TIMELINESS OF THE ACTIVITIES OR MATERIALS RELATED TO THE ACTIVITIES, WHICH MATERIALS MAY CONTAIN ERRORS, INCLUDING PRICING ERRORS AND ERRORS IN THE DESCRIPTION OF THE TRAVEL PRODUCTS. BC FERRIES EXPRESSLY RESERVES THE RIGHT TO CORRECT ANY PRICING ERRORS ON PENDING RESERVATIONS.  THIS RIGHT APPLIES REGARDLESS OF WHETHER YOUR RESERVATION HAS BEEN CONFIRMED OR YOU HAVE BEEN CHARGED FOR IT. 

IN THE CASE OF A PRICING ERROR, BC FERRIES WILL OFFER YOU THE OPTION TO KEEP YOUR PENDING RESERVATION AT THE CORRECT PRICE OR BC FERRIES WILL CANCEL YOUR RESERVATION WITHOUT PENALTY. BC FERRIES AND ITS AFFILIATES DISCLAIM AND EXCLUDE TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALL WARRANTIES, REPRESENTATIONS, AND CONDITIONS REGARDING USE OF THE ACTIVITIES, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, WHETHER EXPRESS OR IMPLIED AND WHETHER ARISING FROM A COURSE OF DEALING, USAGE, OR TRADE PRACTICE. BC FERRIES AND ITS AFFILIATES ARE NOT RESPONSIBLE FOR ANY INJURY, ACCIDENTS OR DEATH, OR INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES WHATSOEVER ARISING OUT OF OR IN CONNECTION WITH THE USE OR THE AVAILABILITY OF THE ACTIVITIES, INCLUDING WITHOUT LIMITATION ANY BUSINESS INTERRUPTION, LOSS OF USE, LOST DATA, LOST PROFITS, FAILURE TO REALIZE EXPECTED SAVINGS, OR ANY PECUNIARY LOSS, WHETHER IN AN ACTION OF CONTRACT, CIVIL LIABILITY, NEGLIGENCE, OR OTHER TORTIOUS ACTION, EVEN IF BC FERRIES OR ITS AFFILIATES HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGES OR SUCH DAMAGES ARE REASONABLY FORESEEABLE. 

THE THIRD-PARTY SUPPLIERS PROVIDING ACTIVITIES ARE INDEPENDENT CONTRACTORS AND NOT AGENTS OR EMPLOYEES OF BC FERRIES OR ANY OF ITS AFFILIATES.  BC FERRIES AND ITS AFFILIATES ARE NOT LIABLE FOR THE ACTS, ERRORS, OMISSIONS, REPRESENTATIONS, WARRANTIES, BREACHES OR NEGLIGENCE OF ANY SUCH THIRD-PARTY SUPPLIERS OR AGENTS OF THIRD-PARTY SUPPLIERS OR FOR ANY PERSONAL INJURIES, DEATH, PROPERTY DAMAGE, OR OTHER DAMAGES OR EXPENSES RESULTING THEREFROM.  THIRD-PARTY SUPPLIERS MAY IMPOSE TARIFFS AND CONDITIONS THAT ARE UNKNOWN TO BC FERRIES. BC FERRIES AND ITS AFFILIATES WILL HAVE NO LIABILITY AND WILL MAKE NO REFUND IN THE EVENT OF ANY LOSS OR DAMAGE OF BAGGAGE OR OTHER PROPERTY, DELAY, CANCELLATION, OVERBOOKING, STRIKE, FORCE MAJEURE OR OTHER CAUSES BEYOND ITS DIRECT CONTROL AND WILL HAVE NO RESPONSIBILITY FOR ANY ADDITIONAL EXPENSE, OMISSIONS, DELAYS, RE-ROUTING OR FOR ANY ACTS OF ANY GOVERNMENT OR AUTHORITY. Vacation Package Terms and Conditions


You (the “guest”) acknowledge and agree that BC Ferries has independently contracted with ERTCU Travel Group DBA En Route Travel Canada (“En Route Travel Canada”) to arrange the guest’s travel, tour, transportation, accommodation and other products or services independently of BC Ferries, and accordingly, by purchasing a booking, you expressly acknowledge and agree to (A) BC Ferries’ terms and conditions, and (B) En Route Travel Canada’s terms and conditions, each as set out below.
 

(A) BC Ferries’ Terms & Conditions

By purchasing a booking, you acknowledge your acceptance of BC Ferries Vacations Terms & ConditionsBC Ferries’ Conditions of Carriage and Rules & Requirements.
 

(B) En Route Travel Canada’s Terms & Conditions

Important Travel Info: If travelling from outside Canada (including from and to the USA) guests will require a passport for entry into Canada and appropriate government-issued identification (ID) and possibly Visa and/or other Travel Authorization for all family members. En Route Travel Canada is not responsible for guests refused entry into Canada or the United States because of inadequate documentation.

Special Requirements: In case of the rental of a car, RV or other motor vehicle, the minimum requirements include: all drivers must be 25 years of age or older, possess a valid drivers license, and hold a major credit card.

If the driver’s license is not in English, an International Driving Permit is strongly recommended and may be required. This is required for translation purposes to confirm the validity of the driver’s license for the safety of renters and for the rental company.

Incidentals: Any incidentals charged by suppliers (for example, the RV rental company or the campground operator) will be the responsibility of the guest. This includes, but is not limited to, damage deposits, additional insurance, extra mileage, RV upgrades, parking, campground additions.

Documentation: Approximately 4 weeks prior to departure, an information package with vouchers and additional details will be sent electronically to the guest from BC Ferries Vacations.

Discrepancies: In the unlikely event that a guest encounters an issue during their journey, the guest is required to contact BC Ferries Vacations / En Route Travel Canada immediately to resolve the problem.

Disclaimer of Liability: En Route Travel Canada will not be responsible for the performance of the services to the guest if prevented or delayed by acts of God, Force Majeure, terrorist activities, social or labour relations matters, mechanical or structural integrity of air, sea, and ground transportation and accommodations, viral outbreak, accidents, climatic and natural conditions including but not limited to forest fires and earthquakes, traffic, airport conditions, lack of performance by third party suppliers, other causes beyond their reasonable control from meeting its terms.

Nor will they be responsible for any loss or damage relating to any changes or cancellations. En Route Travel Canada acts as an agent for and makes arrangements with hotels, campgrounds, rental companies, and other independent parties to provide you with travel services and accommodations. Although great care is taken to choose suppliers, we are unable to directly control them and therefore we are not responsible for their acts or omissions. The travel services provided by these suppliers are subject to the conditions imposed by the suppliers, and their liability may be limited by their tariffs, conditions of carriage, and international conventions and agreements.

You assume all risks of your participation in all travel services, accommodations, and other services, facilities, products, or events provided in connection with this Agreement (all of which are collectively referred to as the “Tour”), and you waive and release all claims that you may have or acquire against En Route Travel Canada and their respective officers, directors, employees, and agent (all of whom are collectively referred to as the “Releasees”) arising from or related, directly or indirectly, to the Tour, including claims arising from the negligence of any Releasee, and including (without restriction) claims for or arising from personal injury, death, property damage, delay, inconvenience, advertising, misrepresentation, loss of revenue or profit, loss of enjoyment, upset, distress, or frustration, whether physical, mental, or otherwise, expenses, travel, or accommodation costs, claims for punitive damages, claims for unjust enrichment, profits, waiver of tort, non-monetary loss, injunctive relief, or any other form of remedy.

Change & Cancellation: The following limitations, exclusions, restrictions and/or third party operator policies/fees apply in addition to the BC Ferries Vacations cancellation and change terms and fees set out below.)
A change in the departure date or itinerary will be considered a change to the itinerary and may be considered a cancellation. Any changes that result in costs incurred by BC Ferries or En Route Travel Canada will be responsibility of the guest. All changes are subject to availability, and are not permitted less than 30 days prior to departure.
Changes to the guests itinerary or cancellations made any time after confirmation are subject to a minimum charge of $100 or 10% of the total package cost; changes or cancellations made 31-61 days prior to departure are subject to a minimum charge of $500 or 50% of the package cost; changes or cancellations made 30 days or less prior to departure are 100% non-refundable.

En Route Travel Canada reserves the right to modify, alter, or substitute all or any part of its services when reasonably necessary or advisable. Should this occur, En Route Travel Canada agrees to provide the best alternative reasonably available. Every effort will be made to adhere to the specifics shown herein; however, circumstances may necessitate alteration, including the occasional accommodation change from properties. Hence, all fares, schedules, itineraries, hours of arrival and departure, and special programs are subject to change without notice at any time. En Route Travel Canada (and BC Ferries by association) will not, under any circumstances, be liable to refund the charges as a result of En Route Travel Canada’s modification, alteration, or substitution of services. Due to possible low availability in high traffic regions, En Route Travel Canada reserves the right to book a campground up to 50km away from the original confirmed destination or campground location.

For RV, car, or motorhome rental, the driver must be 25 years of age or older, possess a valid drivers license, and hold a major credit card.
